Section 33
To apply for a banking and financial transaction license
(1) A bank or financial institution wishing to conduct banking or financial transactions in accordance with this Act shall submit an application to the National Bank along with the documents prescribed by the National Bank to obtain a license. It should be attached:- (a) A copy of the bank or financial institution's memorandum of association, regulations and the certificate of incorporation in accordance with the prevailing law, (b) Details of the office building with all the infrastructure necessary to conduct the business, or if the building is leased, a copy of the lease agreement. Details of the building with sufficient basis to provide banking and financial services and facilities, (c) Documents proving that the amount of shares agreed to be taken by the founder has been paid and deposited in the National Bank, (d) Employees of the bank or financial institution related to services, conditions and facilities regulations, regulations related to financial administration and regulations related to loan deregistration, (e) the location of the main place of business or the address of the branch if it has been determined, (f) the approval to follow the conditions set by the National Bank for doing banking and financial transactions, (g) the bank or A business plan prepared to include the financial institution's business strategy and the nature of the business to be conducted, the organizational structure including internal control and risk management process, (h) the list of directors and officers of the bank or financial institution and details of those who are eligible to be directors or officers according to this Act, j) Commitment to maintain the minimum capital as determined by the National Bank from time to time until conducting banking or financial transactions, (j) Commitment to maintain an internal control system to manage all potential risks in an appropriate manner by the bank or financial institution, (k) Other requirements determined by the National Bank from time to time. Details and documents. (3) In the case of a bank or financial institution established by a foreign bank or financial institution as a joint investment in Nepal.In addition to the matters mentioned in sub-section (2), the following documents or details should also be submitted to the National Bank:- (a) In case of 'A', 'B', 'C' and 'D' category banks or financial institutions, foreign banks or financial institutions. In accordance with the law of the respective country, the approval or consent letter given by the government or the central bank or regulatory body of such country to such foreign bank or financial institution to conduct banking and financial transactions in Nepal, (b) after submitting an application to the National Bank to establish a foreign bank or financial institution or After obtaining permission from the bank, if there is any difference in the matters to be completed by such foreign bank or financial institution in accordance with this Act, details thereof, (c) other information and details as requested by the National Bank. (4) If any documents or details are not provided or insufficient during the examination of the documents or details received in accordance with sub-section (2) or (3), the National Bank may request additional documents or details from such bank or financial institution.
